1. Introduction

These Terms and Conditions (“Terms”) govern your access to and use of the Zelova platform, including the website at zelova.ai, all associated applications, AI-powered coaching services, and any content or documents generated through the platform (collectively, the “Service”).

The Service is operated by Zelova AI Ltd, a company registered in England and Wales (Company No. 17141459), with its registered office at 71-75 Shelton Street, Covent Garden, London, WC2H 9JQ (“Zelova”, “we”, “us”, or “our”). Zelova AI Ltd is registered with the UK Information Commissioner's Office (ICO) under reference ZC118310.

By creating an account and using the Service, you agree to be bound by these Terms. If you do not agree, you must not use the Service.

2. Definitions

  • “Service” means the Zelova AI-powered career strategy platform, including all features, tools, coaching conversations, document generation, and related services.
  • “User”, “you”, or “your” means any individual who registers for and uses the Service.
  • “Subscription” means the recurring payment arrangement under which you access the Service.
  • “User Content” means any information, data, text, or other content you provide through the Service, including career history, preferences, and coaching conversation inputs.

3. Account Registration

You must create an account to use the Service. Account registration is also required to make a purchase. You agree to provide accurate, current, and complete information during registration and to keep your account details up to date.

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify us immediately at support@zelova.ai if you become aware of any unauthorised use of your account.

We reserve the right to suspend or terminate any account at our sole discretion, including but not limited to cases of violation of these Terms, suspected fraudulent activity, or if you are a person or entity designated by a sanctioning authority.

4. Service Description

Zelova provides an AI-powered career strategy service. The Service may include personalised career planning, AI coaching conversations, document generation, market research, and strategic recommendations.

Important: The Service provides information and guidance only. It does not constitute professional career advice, legal advice, financial advice, or psychological counselling. You should seek independent professional advice where appropriate.

To access the Service, your device must meet commonly used and up-to-date technical requirements, including a modern web browser with an active internet connection.

5. Subscriptions and Payments

5.1 Subscription Model

The Service is offered on an open-ended subscription basis. Your Subscription continues until cancelled by you or terminated by us in accordance with these Terms. There is no fixed term.

5.2 Pricing

Prices are displayed inclusive and exclusive of applicable fees, taxes, and costs, depending on the part of the platform being viewed and your location. Current pricing is available on our website.

5.3 Payment Processing

All payments are processed through third-party payment services. We do not directly handle or store your payment card details. By subscribing, you authorise the applicable third-party payment provider to charge your chosen payment method on a recurring basis.

5.4 Cancellation by You

You may cancel your Subscription at any time by contacting us at support@zelova.ai. Cancellation takes effect immediately upon processing. You will retain access to the Service until the end of your current billing period.

5.5 Termination by Us

We may terminate your Subscription at any time, with immediate effect, for cause. Cause includes but is not limited to: breach of these Terms, violation of acceptable use policies, impossibility of performance, or if you are a person or entity designated by a sanctioning authority.

5.6 Refunds

Except where required by applicable law (including your statutory rights of withdrawal, cancellation, or regret as described in Section 10), fees are non-refundable.

6. Free Trials

We may offer free trial periods at our discretion. During a trial, you will have access to the Service at no charge for the specified period.

At the end of the trial period, your access will end. The trial does not automatically convert into a paid subscription. If you wish to continue using the Service, you will need to subscribe separately.

7. User Content and Intellectual Property

7.1 Your Content

You retain ownership of all User Content you provide through the Service. By using the Service, you grant Zelova a non-exclusive, worldwide, royalty-free licence to use, process, store, and display your User Content solely for the purpose of operating and improving the Service.

User Content is provided under the same general rights as other content on the platform. You are responsible for ensuring that your User Content does not infringe the rights of any third party.

7.2 Our Content

All content generated by the Service, including AI-generated documents, strategies, and recommendations, remains the intellectual property of Zelova AI Ltd. You are granted a personal, non-transferable licence to use this content for your own career development purposes.

You may not resell, redistribute, or commercially exploit any content generated by the Service without our prior written consent.

7.3 Platform Intellectual Property

The Service, including its design, features, algorithms, and underlying technology, is the intellectual property of Zelova AI Ltd. Nothing in these Terms grants you any rights to our intellectual property except the limited licence to use the Service as described herein.

8. Acceptable Use and Content Moderation

8.1 Acceptable Use

You agree to use the Service only for its intended purpose of career development and strategy. You must not:

  • Use the Service for any unlawful purpose or in violation of any applicable laws or regulations
  • Submit content that is defamatory, obscene, threatening, discriminatory, or otherwise objectionable
  • Attempt to gain unauthorised access to the Service, other users' accounts, or our systems
  • Use automated tools, bots, or scrapers to access or extract data from the Service
  • Interfere with or disrupt the integrity or performance of the Service
  • Reverse-engineer, decompile, or attempt to extract the source code or algorithms of the Service

8.2 Content Moderation

We reserve the right to review, moderate, and remove any User Content that violates these Terms or our acceptable use standards. We may also suspend or terminate accounts that repeatedly breach these standards.

9. Data Protection and Privacy

Your use of the Service is also governed by our Privacy Policy, available at https://www.iubenda.com/privacy-policy/85759864. By using the Service, you acknowledge that you have read and understood our Privacy Policy.

We require you to provide certain personal data in order to deliver the Service. This data is processed in accordance with our Privacy Policy and applicable data protection legislation, including the UK GDPR, EU GDPR, and other relevant laws.

Purchase-related communications will be sent to the email address associated with your account.

10. Your Statutory Rights

10.1 Right of Withdrawal (EU Consumers)

If you are a consumer in the European Union, you have the right to withdraw from your contract within 14 days of subscribing, without giving any reason. This right of withdrawal applies to European consumers only.

To exercise your right of withdrawal, you must inform us of your decision by contacting support@zelova.ai with a clear statement. We will reimburse you within 14 days of receiving your withdrawal notice, using the same payment method you used for the original transaction.

10.2 Right to Cancel (UK Consumers)

If you are a consumer in the United Kingdom, you have the right to cancel your contract within 14 days of subscribing. The Service has a price fixed in advance.

10.3 Right of Regret (Brazilian Consumers)

If you are a consumer in Brazil, you have the right of regret and may cancel your contract within 7 days of subscribing. The Service has a price fixed in advance.

11. Guarantees and Conformity

For consumers in the European Union, we provide the mandatory guarantee of conformity for digital services as required by applicable EU consumer protection law.

For consumers in Brazil, we provide the mandatory guarantee of conformity for services as required by the Brazilian Consumer Defence Code.

12. Limitation of Liability

To the maximum extent permitted by applicable law:

  • The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied.
  • We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components.
  • We are not liable for any decisions you make based on information or recommendations provided by the Service.
  • Our total aggregate liability to you for any claims arising from or related to the Service shall not exceed the amount you have paid to us in the 12 months preceding the claim.

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited by applicable law.

13. Indemnification

You agree to indemnify and hold harmless Zelova AI Ltd, its directors, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in connection with your use of the Service, your User Content, or your breach of these Terms.

14. Dispute Resolution

If you have a complaint or dispute regarding the Service, we encourage you to contact us first at support@zelova.ai. We will endeavour to respond within 2 working days and to resolve the matter amicably.

If we are unable to resolve the dispute informally, the dispute shall be governed by the process set out in Section 16 (Governing Law and Jurisdiction).

15. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will notify you by email or through the Service. Your continued use of the Service after such notification constitutes acceptance of the updated Terms.

If you do not agree with the updated Terms, you may cancel your Subscription in accordance with Section 5.4.

16. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of England and Wales.

Any disputes arising from or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales, except where applicable consumer protection laws grant you the right to bring proceedings in your local courts.

Nothing in these Terms affects your statutory rights as a consumer.

17. Account Deletion

You may request deletion of your account at any time by contacting us at support@zelova.ai. We will process your request and delete your account and associated data in accordance with our Privacy Policy and applicable data protection law.

We may also delete or suspend accounts unconditionally at our discretion, including for inactivity, violation of these Terms, or operational reasons.
